
OptimaPay – Terms & Conditions
These Terms & Conditions (“Terms”) govern the use of OptimaPay, operated by Brandhow S.R.L. (“OptimaPay”, “we”, “us”, “our”), and apply to all users (“Customer”, “User”) submitting payments via the OptimaPay platform.
By submitting a payment, you agree to these Terms.1. Scope of Service
OptimaPay provides a technical payment facilitation and orchestration service that enables Customers to submit payments for official government-related fees, including visa application fees, via licensed third-party payment service providers (“PSPs”).
OptimaPay:
• does not act as a bank, payment institution, electronic money institution, or card issuer;
• does not provide regulated payment services;
• does not hold, safeguard, or settle customer funds.
All payment transactions are executed exclusively by licensed third-party PSPs.2. Contract Formation
A binding contract is formed when:
1. the Customer submits a payment via OptimaPay; and
2. the Customer receives a digital confirmation of the transaction.3. Service Delivery
• Services are delivered digitally only.
• Delivery occurs after successful settlement of the payment as confirmed electronically.
• No physical goods or documents are delivered.4. Fees & Pricing
• OptimaPay does not charge service, processing, or convenience fees, unless explicitly stated otherwise.
• All amounts paid correspond exclusively to official government visa or application fees set by the competent authority.
• Fees charged by banks, card networks, or PSPs are outside OptimaPay’s control.5. Payments & Third-Party Providers
• Payments are processed by licensed third-party PSPs.
• Availability depends on country, currency, payment method, and regulatory constraints.
• OptimaPay does not guarantee payment authorization, acceptance, or settlement.
The contractual relationship for payment execution exists directly between the Customer and the PSP.6. Chargebacks & Recovery Rights
Unlawful, fraudulent, or unjustified chargebacks:
• will be formally disputed;
• may be reported to issuing banks, card networks, or competent authorities;
• may result in recovery actions, including administrative fees where legally permitted.7. Fraud Prevention & Security
OptimaPay may:
• block, suspend, or cancel transactions flagged as suspicious;
• request additional verification or identification;
• delay processing where required for security, compliance, or fraud-prevention reasons.
Failure to provide requested information may result in transaction rejection.8. User Obligations
Customers must:
• provide accurate and truthful information;
• use the service only for lawful purposes;
• comply with applicable laws and regulations;
• refrain from fraudulent or abusive conduct.9. Data Protection
Personal data is processed in accordance with applicable data-protection laws, including the GDPR.
Sensitive payment data (e.g. card details) is processed exclusively by third-party PSPs.

OptimaPay is provided on a best-effort basis.
Temporary unavailability may occur due to maintenance, technical issues, or third-party outages.11. Limitation of Liability
To the maximum extent permitted by law:
• OptimaPay is not liable for payment failures, delays, or PSP decisions;
• OptimaPay is not liable for indirect or consequential damages;
• Liability is limited to cases of intent or gross negligence where legally required.12. Suspension & Termination
Access may be suspended or restricted if:
• these Terms are breached;
• fraud or misuse is suspected;
• required by law, regulation, or PSP instruction.13. Governing Law & Jurisdiction
These Terms are governed by EU law and the laws of Romania.
Exclusive jurisdiction lies with the competent courts of Romania.14. Amendments
The version published on this website at the time of payment applies.
OptimaPay may update these Terms as required by law or regulatory changes.
OptimaPay – Privacy Policy

OptimaPay does not store full card numbers or CVV codes.3. Purpose & Legal Basis
Data is processed for:
• payment facilitation and confirmation;
• fraud prevention and security;
• legal and regulatory compliance.
Legal bases (Art. 6 GDPR):
• contract performance (Art. 6(1)(b));
• legal obligations (Art. 6(1)(c));
• legitimate interests (Art. 6(1)(f)).4. Third-Party PSPs
Payments are processed by licensed PSPs acting as independent data controllers under their own privacy policies.5. Retention
• Transaction records: up to 10 years (statutory obligations)
• Technical logs: up to 6 months6. Data Subject Rights
Users have the right to access, rectify, erase (where lawful), restrict processing, and lodge a complaint with a supervisory authority.

OptimaPay – Refund & Cancellation Policy
All payments processed via OptimaPay relate to official government visa or application fees.
• Such fees are generally non-refundable.
• Refunds are issued only if required by applicable law or formally mandated by the competent embassy or authority (e.g. confirmed system error).
• OptimaPay does not issue refunds at its own discretion.
Approved refunds are returned to the original payment method within 7–14 business days, depending on the PSP.
